Baby shaken: father sentenced to 17 months in prison

The girl was slightly injured. The mother filmed the incident with a hidden cell phone. The man is also said to have beaten her and threatened to kill her. The judgment is not final.

Judge Karin Lückl found the father of the family guilty of torturing and neglecting an underage, younger and defenseless person, attempted coercion, bodily harm, dangerous threats, fraud and embezzlement. He has to pay his daughter 500 euros in compensation. In addition to the 17 months in prison, there are also three additional weeks that were conditionally suspended from a previous prison sentence.

“Incredible luck”

In July 2022, the father is said to have hit the baby on the head and face with the palm of his hand several times within an hour. According to the prosecution, he may have closed his mouth, covered his head with a blanket and held the infant up and shook it all over his body. Lückl emphasized that it was “incredibly lucky” that the girl was not seriously injured.

The incident was recorded by the baby’s mother, who had a hidden cell phone filmed while the defendant was alone with the child. She suspected that something was wrong in the relationship between father and daughter because the otherwise quiet child often screamed a lot when she was alone in a room with the 28-year-old. He generally didn’t care much about the baby and actually only spent time with the second, slightly older daughter.

Overwhelmed with life situation

The father confessed in court to hitting and shaking the infant. He was overwhelmed by his life situation. On the day of the incident, he looked after his two daughters alone with a broken ankle and didn’t know what to do. The judge interjected that it could be seen in the video that the child was relatively calm and slept next to him. “It was a short-circuit reaction,” said the defendant. He is also very sorry for this.

He denied that he hit his partner and threatened her and the children – as well as order fraud. The man is said to have ordered two trampolines with accessories and two basketball hoops, even though he was already in debt and could not pay for them. He subsequently sold one of the trampolines online. The 28-year-old mostly gambled away the money they had, said the children’s mother. The younger daughter was very nervous for a few months after the incident. But now she is doing well again.
