The doctors could no longer save the little boy’s life.

His defense attorney Astrid Wagner believes he is “innocent,” as she said on Wednesday after visiting the 29-year-old who was imprisoned in the Josefstadt prison. The man and the 26-year-old mother are in custody, and the public prosecutor is investigating both of them for murder.

“He doesn’t put a strain on his mother either.”

While the mother and her defense attorney Liane Hirschbrich have not yet commented on the suspicion – the suspect exercised her right to refuse to testify – the father’s legal representative emphasized that he denied having used violence against his children. In addition to the son, who died in the third month, there is a two-and-a-half-year-old daughter who now lives with crisis foster parents. “It doesn’t put a strain on the mother either,” emphasized Wagner. The injuries that led to the infant’s death are a mystery to her client: “He believes something happened in the hospital during the rescue efforts.”

The 26-year-old mother went to the hospital with the baby at 11 p.m. on February 3 because there was said to be a medical emergency. “There have been problems with the child in the past. It was abnormal, it was a child with seizures,” said Wagner. The parents therefore repeatedly sought medical help.

Shaken trauma and broken bones

But on February 3rd, any help came too late for the little boy. At the time of his hospital admission, he probably no longer had any brain functions due to injuries that were not externally visible. Three days later, the life support machines were switched off and the boy was pronounced dead. The hospital subsequently alerted the police after an MRI scan revealed brain injuries that typically indicate so-called shaken baby trauma. The small body also had a broken arm and a broken rib.

The written autopsy report requested by the public prosecutor to clarify the exact cause of death is not yet available. The next regular detention examination date for the parents is the end of March.
