Last year, the Court of Auditors examined the events surrounding the future operational development area “Ehrenfeld II Viecht” checked. The report published in December stated that the clearing of almost 19 hectares of forest “not properly established” came. She happened “without sufficient examination of the requirements”. It was criticized that the state of Upper Austria did not require an environmental impact assessment and that the Gmunden district administration waved through the clearing without all the prescribed replacement afforestation areas having been determined.

Criminal law relevance

This “Approach of decision makers” has criminal relevance for Proksch. However, the Court of Auditors will not take any legal action; this will only be done in exceptional cases, for example in the course of an audit “imminent danger” a spokesman said. If there are criminal suspicions in the final report, the public prosecutor’s office can also take action on its own initiative. It was initially not known whether the responsible public prosecutor’s office in Wels did this.

If nothing moves in this case by mid-March, AllRise will file a complaint based on the Court of Auditors’ report for possible abuse of official authority against the decision-makers and intentional harm to the environment, Proksch clarified.

Eypeltauer wants a commission of inquiry in the state parliament

The NEOS would also like to clarify the political responsibilities in the case. Therefore, club chairman Felix Eypeltauer, as chairman of the control committee, wants to submit a proposal for an investigative commission to the state parliament at the meeting on March 20th. It must “the suspicion of political influence and patterns of structural corruption” be followed up.
