Reddit and YouTube in court over supermarket attack

The Internet services contributed to radicalization by providing the white gunman with information about equipment and training for his mass shooting, Judge Paula Feroleto of the Erie County Superior Court explained on Monday in admitting the lawsuit.

In their motions to dismiss the lawsuit, Reddit and YouTube argued that they were merely offering third-party content and were not liable under any federal law regulating such content or under the First Amendment to the United States Constitution. However, the psychological distress caused to many witnesses by the “horrific” attack was a special circumstance in a legal sense that justified pursuing claims of negligence, the judge explained.

YouTube announces appeal

The lawsuit was filed by 25 witnesses to the shooting on May 14, 2022, as well as the son of one of those killed. The timing of the decision does not appear to be related to Reddit’s IPO, which is scheduled to be priced on Wednesday. YouTube has already announced that it will appeal.

The then 18-year-old perpetrator shot ten African Americans and injured three other people. He pleaded guilty to murder and hate terrorism, among other charges, and was sentenced to life in prison without parole in February 2023. Federal charges have also been brought against him, and the US Department of Justice is seeking the death penalty.
