The lawsuit filed in federal court in upstate New York states that Letitia James, of Democratic affiliation, is violating the constitutional rights of the Republican magnate with a politically motivated investigation.
“Her mission is guided solely by political animosity and the desire to harass, intimidate and retaliate against a private citizen whom she sees as a political opponent,” it was alleged.
James is investigating whether the Trump Organization may have illegally reported false values on his properties, potentially to obtain bank and tax advantages.
In a statement released Monday, James described Trump’s lawsuit as “an attempted collateral attack” on the investigation.
“Our investigation will continue unaffected because no one is above the law, not even someone by the name of Trump,” he stressed.
Trump’s lawsuit comes after The Washington Post reported earlier this month that James had asked him to testify in person at his office on January 7.
James launched the investigation in March 2019 and suspects that the Trump Organization fraudulently overstated the value of certain properties when seeking bank loans, then reported much smaller quotes when declaring assets so they could pay less taxes.
Trump’s son Eric, who is the organization’s executive vice president, was interviewed by James’s office on the matter in October 2020.
Donald Trump is under pressure from various legal investigations.
For example, he was interrogated for more than four hours on October 18 as part of a lawsuit by a group of protesters who allege that their security guards attacked them six years ago.
And the Trump Organization is also under investigation by the Manhattan District Attorney for possible financial crimes and insurance fraud.
