A state appeals court judge rejected this Monday Donald Trump’s request. The Republican candidate asked to urgently postpone his imminent criminal trial in New York.
The judge rejected the request in a one-line ruling late Monday afternoon without explanation.

The ruling by Judge Lizbeth González of the state Appellate Division came after the former president’s lawyers argued that it was necessary to stop the trial because “an impartial jury cannot be selected at this time due to prejudicial publicity prior to the trial.”

The trial takes place in the middle of the electoral campaign.

He failure occurred just a few hours after Trump lawyers to file last-minute bid to delay trial which centers on allegations that Trump falsified business records related to secret money payments.
The move came exactly a week before the first trial of a former president is scheduled to begin.
Trump’s lawyers’ attempt to postpone the trial
The hearing on the challenge to the seat took place this Monday afternoon, and at the same time Emil Bove, Trump’s lawyer, argued that jury selection cannot proceed in a fair manner because of all the publicity surrounding the case, and that the gag order against his client is unconstitutional.
Steven Wu, part of the prosecution, replied that the advertising is not limited to Manhattan, but is global.due in part to Trump’s frequent comments about the case. Suggested Trump was “trying to have the best of both worlds”by complaining about advertising and at the same time feeding it.
Trump’s lawyers filed the challenge as a lawsuit and invoked a provision of New York law known as Article 78. A complaint under Article 78 allows litigants, whether in an ongoing legal battle or otherwise, to seek relief for a state or local government action allegedly illegal.
Donald Trump’s previous attempt to postpone the trial
Trump attempted a similar maneuver before the appeals court last yearwhen he challenged a partial gag order issued by Judge Arthur Engoron in the civil fraud case brought against the former president and his company by New York Attorney General Letitia James.
The appeals court rejects Trump’s request to suspend the case while he appealed the order and ultimately ruled against him. In the ruling, they chastised their lawyers for presenting the challenge as an Article 78 petition, which they considered a “extraordinary resource” which was not justified in this situation.
