20, if not 30 young swans would literally “besiege” fields and fields in a town in Garsten, they would eat the cultivated crops and their feces would contaminate the feed for farm animals: this year the Steyr-Land district administration received an application for the forced shooting of 5 young ones mute swans.

Since April 1, 2024, forced killing of animals has been permitted if this is necessary to prevent damage to agricultural crops. This was made possible by the amendment to the Upper Austrian hunting law.

An agricultural expert would have had to clarify whether there was any concrete damage at all. But according to the court, BH failed to obtain such an expert opinion. Instead, there was a statement from the official expert on hunting issues, but that was therefore not sufficient.

The State Administrative Court decided that because a central, technically sound investigative step had been omitted, the decision had to be revoked. The matter was referred back to the BH to carry out the necessary further inquiries.

An animal protection association filed a timely complaint against the shooting decision, so the case was reviewed by the administrative court.
