The rejection of the petition appeal by Sartori had the negative vote of 26 senators, while the substitute senator who replaces Sartori, Juan Straneo, He left the room. Prior to this Tuesday’s vote, the issue was discussed in the parliamentary committee where the senator of the Frente Amplio, Sebastián Sabiniwas in charge of communicating the conclusions.

“Senator Sartori was declared in breach of his obligations in relation to the sworn statements by the Jutep on November 1 of last year. This resolution established the retention of 50% of the salaries received by the senator, something provided for by law,” Sabini said.
Meanwhile, he stressed that the sanctioning power belongs to the Jutep and that the parliamentary commission does not have the resources to address Sartori’s request. “We discussed in the commission whether it was appropriate for the commission to issue it. Sartori makes a statement and we understand that the commission has no powers; In any case, I should have gone to the Administrative Litigation Court. We understand that the commission is incompetent for an appeal like the one proposed by the senator. We establish the laws, but we do not execute them,” he explained and, therefore, stressed that Sartori’s request is inadmissible.
The Sartori case
The senator of National Party, Juan Sartoriwas declared omitted in November of last year by the Jutepafter he refused to deliver the sworn declaration of his wife’s assets, Yekaterina Rybolovleva.
The administrative process began in 2022 when an investigation was opened due to an irregularity in the documentation presented by the white senator. The senator’s response, to the claim of her wife’s sworn declaration of assets, was that he could not operate on her will and has even gone so far as to file an appeal in the Supreme Court of Justice (SCJ), although it was dismissed because it was considered unconstitutional.
The board’s decision was unanimous and was made up of the president of Jutep, Gabriela Dilongo – representing Cabildo Abierto – and the directors of the National Party and Frente Amplio, Guillermo Ortiz and Ana Ferraris, respectively. Meanwhile, the sanctions that the senator can receive are marked by the Crystal Law of Public Officials where it is established in article 16 that the leader “will not be able to exercise public office again until he or she submits the omitted declaration.”
On the other hand, Jutep retained the 50% of salary of the senator based on the rule that establishes that the state entity must communicate “the status of omission to the body in which the official works, for the purposes of applying the disciplinary measures relevant and withholding provided for by article 99 of Law No. 18,046. , of October 24, 2006, or, where appropriate, to the corresponding social security organizations.”
