As soon as he arrived at the White House, Biden suspended the Migrant Protection Protocols (known as “Stay in Mexico” or MPP) but a judge in a court in the state of Texas (south) ordered that they be reinstated “in good faith.”
On December 6, the United States partially reactivated the program, in agreement with Mexico, to comply with that order, while pursuing an appeal filed with the appellate court, which agreed with the district court.
Now the Biden government urges the Supreme Court, where six of the nine justices are conservatives, to “grant certiorari,” that is, accept the case, and “reverse” the appellate court’s ruling.
The lower courts have ordered the Department from Security Interior (DHS) “to implement and enforce indefinitely the MPP program, ephemeral and controversial,” despite the fact that the executive branch considers that “it is not the best tool to deter illegal migration,” the text says.
Stay in Mexico “exposes migrants to unacceptable risks” and “undermines the executive’s foreign relations efforts to manage regional migration,” he adds.
The flow of migrants through Mexico, mostly Central Americans, has increased under Biden’s presidency due to his promises of a “just and humane” immigration policy. Mexican authorities have detected more than 190,000 migrants between January and September, three times more than in 2020.
