The proceedings following a complaint to the Vienna public prosecutor’s office for defamation were discontinued “due to a lack of initial suspicion,” the “Presse” reported online on Friday evening.

After the Vienna Public Prosecutor’s Office examined the case, a report was sent to the Vienna Senior Public Prosecutor’s Office, which in turn ruled, according to the Ministry of Justice, “that the proceedings should be discontinued due to a lack of initial suspicion.” Because it was a clamorous case, i.e. one of broad public interest, the Justice Ministry’s Advisory Council also dealt with it. Neither the Advisory Council nor the relevant department in the department had any objections to the discontinuance, the Justice Ministry told the “Presse.” “The proceedings were therefore discontinued by the Vienna Public Prosecutor’s Office.”
“Zadić stayed out of it”
The Justice Ministry also stressed that the Green Justice Minister Alma Zadić had stayed out of the case: “Immediately after the ministry learned of the complaint against Lena Schilling through media reports,” Zadić “instructed” the responsible department not to inform her and her cabinet staff or to involve them in the matter.
But the case is not yet over for Schilling: next Friday, the court hearing will take place at the Vienna District Court for Innere Stadt regarding the revocation suit brought by the Bohrn Mena couple against her. Schilling is being asked to retract the claims she made about the couple during the EU election campaign.
