The company where he gambled away 30,000 euros in two months is bankrupt and there is nothing to be gained there. However, the Republic of Austria knew about the illegal gambling and did nothing to stop it, argues Julia Eckert, the plaintiff’s lawyer, according to Dossier and the ORF magazine Eco. Therefore, it should compensate him for his losses.

The lawsuit failed in the first two instances. The first instance court saw no connection between the allegedly violated legal norm and the player’s damage. The second instance argued that the gambling monopoly would indeed serve to protect the financial interests of individual players, but that this was only directed at the gambling providers and not at the state, writes Dossier. Nevertheless, Eckert brought the case before the Supreme Court in April 2024 (1Ob 77/24s).
