OSE appeals today against the ruling of Judge Alejandro Recarey

The National Administration of State Water Works (OSE) will appeal the judge’s ruling on Tuesday Alejandro Recarey With respect to Arazati Projectwho three weeks ago ordered the suspension of works for the construction of a water treatment plant.

The state-owned company had announced that it would not file the appeal before the judicial recess and that it would wait until it ends to begin the process. For its part, the Environment Minister Robert Bouvier He warned that his department is continuing to advance “environmental studies” in view of the possibility that this could generate dozens of impacts.

According to El País, OSE will therefore appeal to the judge who ordered the suspension of construction work on the water treatment plant, stating that “there are grounds to assume” a process of partial privatisation of the supply of drinking water.

The Recarey sentence

At the end of June, Recarey granted a precautionary measure of “no innovation” and issued an interlocutory sentence ordering OSE not to sign the contract with the consortium Waters of Montevideo.

The judge admitted a precautionary measure that was presented by the National Commission for the Defense of Water and Life and the Tucu-Tucu group to stop the project. The organizations point to a possible privatization of the running water service and a loss in its quality.

In his sentence to which he agreed AmbitRecarey assures that “there are grounds to assume that we may be facing a process of partial privatization of the public supply of drinking water”, in violation of article 47 of the Constitutionsince “it will be the private sector that designs, builds and maintains the raw water intake infrastructure of the Silver riverits initial analysis, its purification, and finally its transfer to Melilla (in Montevideo)”.

The lawyer also claims that there are “serious indicative factors” which “lead to the conclusion that the metropolitan area’s population could be served with water of a lower quality than it could enjoy (from other, cleaner sources).”

For this and other reasons, Recarey resolved: “To grant the requested measure of non-innovation. And, in its merits, to order OSE not to sign the contract with the Aguas de Montevideo consortium. This is until an express judicial resolution to the contrary is verified.”
