“In theory, the ‘Swifties’ could sue the alleged perpetrators and those who caused damage for damages due to deliberate, immoral damage,” says Andreas Riedler, Professor of Civil Law at the JKU. However, enforcing the claims would be both legally difficult and, above all, factually probably hopeless, as the perpetrators would hardly have sufficient assets to satisfy the approximately 170,000 claims for damages from the fans.
