Last week, at the meeting in Court, Macri He was accompanied by the City Attorney General, Martin Ocampoand the Buenos Aires Minister of Justice, Gabino Tapia. The Secretary of the Treasury represented the Nation, Carlos Gubermanamong other officials.
“We want to give certainty to the people of Buenos Aires that we reached an agreement for the collection of 2.95% that allows us to give answers from the City” had expressed the head of the Buenos Aires Government, upon leaving the meeting in the Buenos Aires neighborhood of Tribunales.
“This is a very important step forward and has good will on both sides, the national government and the City,” added the Head of Government of Buenos Aires. The announcement came after the new hearing called by the Supreme Court of Justice.
How will the co-participation payment be?
The parties resolved at the meeting to present a joint agreement in five business days for compliance with the precautionary measure, which establishes the payment of 2.95% of the co-participation. The objective of this agreement is for payment to be made in the following way:
- 1.40% daily drip.
- 1.55% weekly.
These two payment guidelines make up the total 2.95% announced by Jorge Macri. “While the in-depth discussion continues, because the City has, according to our understanding, a right to 3.50%, the Nation has a different view and we will work on that, but we took a very important step forward“said the Buenos Aires mayor.
In this way, Jorge Macri achieves something that he had been demanding, which is to collect the money that would correspond to him on a daily basis. co-participation. But technically, the national government cannot include CABA’s part in the distribution with the provinces because what there is until now is a precautionary measure from the Supreme Court.
Since the ruling is not final and therefore the City still cannot be said to be the winner of the controversy. In that sense, the agreement that would have to be signed will make it clear that the Nation does not consider the case closed and that in any case it will devise a mechanism for sending by “daily drip” but outside of what Co-Participation is.
“I value the gesture of the national government to seek an agreement and that together we can unblock something that both administrations inherited and that seemed to have no solution,” explained Jorge Macri.
The previous national administration of President Alberto Fernández decided in an unconsulted and unconstitutional manner to take part of the co-participation from the City and lower the coefficient to 1.4.
When the City complained to the Supreme Court, Kirchnerism never complied with the precautionary measure of December 22, 2022, which granted the City a co-participation coefficient of 2.95.
