He Government regulated authorizations for operations airlines with staff and aircraft with foreign registrationin accordance with what was determined by the decree issued last month, by which it was left in the hands of the National Civil Aviation Administration (ANAC), the authorization of these procedures.
The new measures were enabled through the resolution 363/2024published today in the Official Gazettewhere articles 106 and 107 of the Aeronautical Code are regulated (Law 17,285).
Through this regulation, the National Government delegates to the ANAC the implementation of the necessary authorization procedures for foreign personnel to perform aeronautical functions in the services commercial airlinesas well as the use of aircraft foreign registration to operate in our country when an airline requires it.

Among the requirements are the training plans for the crew members, along with the corresponding technical and medical qualifications.

The regulation is executed after decree Nº 844/2024, of September 23, in which the Executive Branch entrusted the ANAC with the granting of authorizations for commercial aviation operations with personnel and aircraft with foreign registration and its corresponding technical regulations, in accordance with international and regional standards.
Requirements and operation of the new regulations
In this way, Article 106 of the Aeronautical Code will allow the employment of foreign personnel in the argentine aeronauticsunder a plan for crew justification, training and validation of their licenses. Through article 107, the incorporation of aircraft registered abroad in commercial and general aviation will be allowed, through certain processes and by complying with international standards.
To make these exceptions, the ANAC will request from the interested airlines all the documentation pertinent so that both the aeronautical personnel can provide services in our country and the aircraft can operate.
The requirements include: crew training plans, along with the technical clearances and medical corresponding. In the case of aircraft, they must present all the documentation that supports the technical and maintenance conditions, along with the certificates that demonstrate the conditions of airworthiness of them.
The purpose of these implementations is to comprehensively reorganize the aviation legislationstreamline administrative procedures, promoting a competitive and flexible market environment so that more people can use air transportation and thus reach all Argentine cities. Under this modality, the “low cost” JetSmartwill incorporate two aircraft with Chilean registration during the course of this month.
