The government of Javier Milei refused to grant union status to the Villa Gesell Lifeguard Union

The Ministry of Human Capital, led by Sandra Pettovello, rejected the request for union status presented by the Villa Gesell Lifeguard Union. As justified in Resolution 683/2024, in this case, the Ministry of Labor determined that no differentiated interests were credited that are not already covered by other trade union organizations with legal status.

Law 23,551 establishes that union status can be granted to an ex-officio union, as long as differentiated union interests that are not already covered by other union organizations that have said status are justified. As detailed in article 30 of the aforementioned law, when there is a union with union status that represents the workers of an activity, and the requesting organization is an ex-officio union, the granting of status is only possible if sufficient differences are demonstrated in the union interests of the represented workers.

Resolution 683/2024 of the Ministry of Human Capital formally provides for the rejection of the request of the Villa Gesell Lifeguard Union to obtain union status. The Secretary of Labor, Employment and Social Security ordered the corresponding notification to the parties involved and the registration of the decision in the National Directorate of Labor Associations.

This concludes a process that began in 2019 and had multiple stages of review and verification. Facing the summer season 2024/2025 Conflicts could flourish as the Union considers whether to launch protests over the decision.

Conflict with other unions

On April 19, 2024, the National Directorate of Trade Union Associations held a hearing to verify membership and collate the data presented. This process included mutual control of the number of contributing members of the organizations involved, with the objective of determining whether the Villa Gesell Lifeguard Union met the requirements to obtain the union status that was finally rejected.
