Cassation advances with the creation of Colleges of Judges to implement the Accusatory System

Three Colleges of Judges were organized for Chubut, Santa Cruz, Tierra del Fuego, and other federal areas.

This change, which will accompany the entry into force of the Federal Criminal Procedure Code in this jurisdiction as of December 2, was formalized by Agreement 10/2024, signed by the plenary session of the Chamber and its president Mariano Borinsky.

The Federal Chamber of Criminal Cassation advanced in the creation of Colleges of Judges to implement the Accusatory System in the federal district of Comodoro Rivadavia. This change, which will accompany the entry into force of the Criminal Procedure Code Federal in this jurisdiction as of December 2, was formalized through Agreement 10/2024, signed by the plenary session of the Chamber and its president Mariano Borinsky.

In this context, three Colleges of Judges were organized for Chubut, Santa Cruz, Tierra del Fuego, and other federal areas: the Review College, made up of the Federal Court of Appeals of Comodoro Rivadavia; the Trial College, made up of judges from the Federal Courts of these regions; and the College of Guarantees, made up of federal judges from Comodoro Rivadavia, Rawson, Esquel, Río Gallegos, Caleta Olivia, Ushuaia and Río Grande.

This new structure responds to the principles of flexibility and rotation, optimizing judicial resources and speeding up response times within the framework of the new adversarial system, which seeks a more efficient and agile adversarial and oral operation. Furthermore, the implemented model, free of fixed courts, allows any judge from the college to be authorized to intervene in hearings.

In line with Law 27,146, the Federal Chamber of Criminal Cassation has the responsibility of organizing these flexible judicial bodies. With it, It is expected that the structural reconfiguration will facilitate an effective transition towards the new adversarial model in the Patagonian provinces, whose operation in December will mark a milestone in the modernization of federal justice in the region.
