The SIGEN demanded that the UBA present documentation on the use of funds

SIGEN’s request to Justice regarding the UBA

The document presented by SIGEN specifies that the governing body of the internal control system “does not intend to audit study plans, content, appointment of authorities, or affect academic freedom”, nor “appoint the internal auditor of the UBA” . Thus, as detailed by the Government, the content of the demand only indicates that the UBA provides information on the destination of public funds and how they were executed.

In the text, the applicants highlighted: “An attempt is made to verify the accounts and internal processes and controls of the universityin order to evaluate the operational efficiency and help provide information to improve the execution of these operations.”

On the other hand, SIGEN demands that Justice urge the university to “render documented account of funds transferred by the National Treasury”. As they explained, in this way the receivership will be able to fulfill its functions within the framework of the activity of internal control, complementary to the external control carried out by the General Audit Office of the Nation (AGN).

The request fell into the hands of the Judge Edgardo Walter Lara Correa who must decide in a new chapter of the conflict between the Government and the universities.

The UBA’s precautionary request

For its part, the UBA presented last Monday a “declarative action of certainty“so that Justice can define whether or not SIGEN can audit it. Furthermore, while it is being resolved, the institution demanded that a precautionary measure that prevents it.

In the document of claim, the precautionary measure was requested to order the National Executive Branch and SIGEN to “abstain to carry out any type of action linked to interventions to this University, under the name of audits and/or any other name that implies the internal control“.

From the educational institution they assured that the Government led by Javier Milei “decided unilaterally conducting an audit based on next October 28lacking the competence to do so,” the UBA’s lawsuit warned.

The lawsuit seeks that Justice “declare the unconstitutionality of art. 8 of Decree 1344/07 and the incompetence of SIGEN to exercise internal control of this University “because they are contradictory and incompatible with the norms, principles and guarantees of the National Constitution”.
