The Supreme Court overturned the sentence of one of the accused and ordered a new trial

Néstor Pavón was sentenced to five years in prison for covering up the femicide of Micaela García. The family appealed because they consider him a co-author along with Sebastián Wagner, who received a life sentence for the crime.

The Supreme Court of Justice of the Nation this Friday revoked a sentence handed down in Entre Ríos by the femicide of the young Micaela Garcíaoccurred seven years ago, due to defects in the application in addressing gender violence. He ordered a new ruling about one of the accused, who had been sentenced to five years for covering up the crime.

Micaela Garcia21 years old, was murdered on April 1, 2017 in the city of Gualeguay, province of Entre Ríos. After leaving a bowling alley, he disappeared and his lifeless body was found days later in an open field, with signs of having suffered physical and sexual violence.

Two men were convicted of the crime in 2017. Sebastián Wagnerwith a prior record, received the pressure sentence life for sexual crimes and Nestor Roberto Pavón to five years in prison for covering up the femicide. Micaela García’s family and the prosecutor’s office appealed the ruling because they accuse Pavón of being a co-author of the crime.

The Chamber of Cassation of Paraná confirmed Wagner’s life sentence, but annulled Pavón’s conviction and ordered a new trial. The defense of the accused appealed and achieved that the Superior Court of Justice of Entre Ríos resolved that the appeals of the accusing parties were incorrectly admitted and annulled the order for a new trial.

Finally, after an appeal from the prosecutor’s office and Micaela’s family, the Supreme Court annulled the Cassation ruling and ordered a new trial that takes into account the gender perspective.

The Micaela Law

The femicide of Micaela Garcia generated a great commotion at the national level and provoked a debate on gender policies that led to lhe mandatory gender training law for the three branches of government, baptized “Micaela.”

It was voted on in December 2018 and enacted the following year, under the government of Mauricio Macri. It was the Ministry of Women, Gender and Diversity, created in December 2019 by Alberto Fernández and dissolved by Javier Milei when he took office in 2023, who supervised its compliance and provided the content.

According to the national government site argentina.gob.ar, this capacity seeks “transmit tools and (de)build common sensesthat question inequality and discrimination, and transform the specific practices of everything we do, each procedure, each intervention, each bill and, ultimately, each of the public policies.”
