The man addressed the young woman at a tram stop on October 29, 2021. When she didn’t respond to him, he grabbed her, allegedly dragged her to a nearby park, and attempted to rape her.
The 17-year-old suffers from insomnia and was therefore out and about at 5.15 a.m. in Favoriten to stretch her legs. The man, who was twice as old, came out of a bar and happened to meet the young woman while waiting for the tram. As the prosecutor explained, he is said to have complimented her first and then simply took possession of her. In the park, he pushed the youngster to the ground on a skater ramp, fixed her and began kissing her. “She was physically inferior to him and had no chance,” the prosecutor reported. By begging the man to use a condom, the young woman was able to distract him for a moment. She managed to run away and a passer-by came to her aid.
During his interrogation, the accused claimed that the 17-year-old had offered him sex for a fee. He refused, so she’s incriminating him. He met her crying on the tram, he felt sorry for her: “I saw her like my child, I just wanted to comfort her.” He “chatted a little” with her. She then asked him for 10 euros and finally offered him sexual intercourse for 50 euros after he explained to her that he only had a 50 note with him. Then she started kissing him. “It wasn’t a problem for me, it’s human,” said the 42-year-old, whose wife was sitting in the auditorium.
The statements of the now 18-year-old, who had been interrogated contradictorily in the investigation, which is why she no longer had to testify against her tormentor in the main hearing, were discussed in camera. Before the jury (chairman: Christoph Bauer) withdrew to consult, the accused once again protested his innocence: “I have an honor! What should I say to my children?”
For the Senate, on the other hand, there was no doubt about his guilt, the statements of the young woman were conclusive, it said a little later in the verdict. Nine previous convictions of the 42-year-old were aggravating when determining the sentence. Most of the prejudices had been set for him because of drug-related offences. “Your first criminal record was in 1998. I was still studying then,” said the presiding judge.
