In detail, regarding what happened during the session in the Senate – after which Kueider was finally removed from his seat -, Lavié Pico stated that “there are no doubts“that Villarruel’s role “has not had any interference in the voting result to which the National Senators finally arrived in the use of their exclusive powers, as it has been strictly limited in the parliamentary order to presiding over the session in question.” In this way, the magistrate refused to give rise to the proposal formulated by the former senator, since would mean to declare “nullity for nullity itself“.

In detail, the magistrate stated that Villarruel’s participation in the session was limited “expressly to the provisions of article 57 of the National Constitution.” He details that the “vice president of the Nation will be president of the Senate; but will not have a vote except in the event that there is a tie in the vote. Despite Kueider’s claim, the judge stressed that no other senator objected to the vice president’s participation.
