No porteño is going to tell us who is going to be our representative

“Yesterday some were happy because the Supreme Court issued a ruling, I’m glad, but in October we raised the need to reform our Constitution and with pride I come to tell you that, once again, we defended the interests of each one of us “Insfrán said at an event.

Along these lines, he went deeper: “No porteño is going to tell us who is going to be our representative, the people of Formosa are going to choose. Even though they (the opposition) would like that ruling to say: ‘so-and-so from the opposition has to to be the governor of Formosa'”.

However, he said that he will comply with the ruling: “I may or may not agree with the ruling, but we have to comply, we will comply. It is a coup de grace to federalism. It is not something delegated to the Nation. “Do not forget: the provinces are pre-existing to the Nation.”

The Court ruled against indefinite reelection in Formosa

Last Thursday, the court ruled in favor of the protection presented by the “Confederación Frente Amplio Formoseño” front and the judges Horacio Rosatti, Juan Carlos Maqueda and Ricardo Lorenzetti They agreed that the challenged clause (approved in 2003) left explicit an ambiguity about whether or not to allow unlimited reelections.

In this way, the alternation in the provincial Executive Branch and in the division of powers was affected, to maintain the democratic system with a correct functioning.

Rosatti, Maqueda and Lorenzetti assured that the provinces “must conform to the limits of the National Constitution” and argued that unlimited reelection “encourages the personalization of power, weakening the system of checks and balances, and granting inappropriate advantages in electoral contests.”

For his part, the judge Carlos Rosenkrantz He stated that this type of electoral practices “erodes” the representation of the rulers and can lead to “authoritarian practices”; He also asserted that Insfrán will complete his mandate without problems.

In short, the ruling establishes that Formosa must modify its Constitution through the “procedures provided for in its regulations”to put a stop to indefinite re-elections, setting a precedent “in the relationship between federalism and the fundamental principles of the republican order.”
