Therapeutic measures accompanying detention are guaranteed in the special prison. Even after he has served his sentence, the man can only count on his release if an expert certifies that he no longer poses a danger to small children. In principle, the induction into the enforcement of measures within the meaning of Section 21 (2) of the Criminal Code is issued without a time limit, but it must be checked regularly whether the relevant requirements are still met. The judgment is not final.
The girl involved was seven years old when the attacks began. Last spring, the elementary school student confided in her mother after being sent home by her teacher because of persistent severe abdominal pain and when she was asked what was going on.
“I was always a kid”
The accused largely confessed. After his arrest on May 4, 2021, he initially denied all allegations. However, when he saw the video with the girl, who had described the assault in a contradictory questioning during the investigation, he had a change of heart, he told the jury: “I had sleepless nights there. That didn’t bother me Leave it alone. That gave me a pang of conscience. So I said to myself, I have to tell you.” Up to this point he had “lied for his own protection” because he was afraid “that I would be rejected by my nephews, nieces, my family”. He knows that he needs therapy: “I know that I have committed a serious crime.”
The girl’s father had died very young. The great-uncle – unmarried, childless, according to public prosecutor Ursula Schrall-Kropiunig never in a long-term relationship – began to take care of the little one in 2020. He taught her to swim and went on trips to the Prater, to Schönbrunn or to the Haus des Meeres – sometimes with her alone, sometimes with the involvement of other great-nephews and nieces. “I was always a child person.” The girl’s mother – his sister’s daughter – was grateful if he looked after the little one or let him stay overnight. “Then I had time for myself once,” the woman stated as a witness.
“I didn’t mean to hurt her”
He “touched and caressed the girl. I didn’t want to hurt her,” said the accused. He then described the incriminated assaults to the jury in detail: “All in all, I violated her seven times. I still have it in mind.” When asked why, he answered “because I didn’t know at the time that I had a problem.”
At the beginning of the trial, defense attorney Astrid Wagner was surprised that the trial took place at all. The entire department – according to reports 34 inmates – in the Josefstadt prison, in which your client who is in custody is being held, has been in quarantine for ten days after a corona infection was detected in a prison guard. Therefore, she was unable to discuss with the accused and prepare for the trial, Wagner said before the trial. She has no idea why the judiciary considers an encounter in the prison to be too dangerous, but why it apparently poses no risk if she meets her client in the courtroom without a glass partition.
The 60-year-old was tested before the trial – but there were no test results at the beginning of the trial. When questioned by the judge, the man said he had been vaccinated twice and thought he was healthy.
