The Buenos Aires Federal Chamber plans to resolve next week, before the judicial fair, si confirm or revoke the processing of the former president Mauricio Macri in the case being followed for alleged illegal espionage of the relatives of the crew members of the submarine Ara San Juan, which sunk in November 2017.

Sources from the appeals court told Télam that the idea is for the resolution to be signed before the start of the judicial fair and assured that at this time the three judges – Mariano Llorens, Leopoldo Bruglia and Pablo Bertuzzi – are working with their respective teams to define their positions.

The judicial spokesmen also announced that, along with the resolution of that incident, the judges are expected to resolve others linked to the procedural situation of the former heads of the Federal Intelligence Agency, Gustavo Arribas and Silvia Majdalani, in the same case.

Before the start of the judicial fair, which will last between July 18 and 29, the judges of the first chamber of the appeals court could also rule on the prosecutions issued in the Buenos Aires Metropolitan Area (AMBA) case, in which investigates political espionage maneuvers in the province of Buenos Aires, although there the analyzes are more delayed.

The case of the AMBA bases and that of espionage against the relatives of the victims of the sinking of the San Juan were processed in Dolores until the end of 2021 when the Criminal Cassation Chamber decided that they would go to the federal courts of Comodoro Py, dragged by the D case ‘Alessio, which was processed in the court of Judge Julián Ercolini.

The former president was prosecuted on December 1 by the federal judge of Dolores, Martín Bava, who found him “criminally responsible for the crime of carrying out prohibited intelligence actions as author by virtue of having enabled the production of illegal intelligence tasks.”

According to the judicial investigation, the then president would have used information obtained through illegal means to anticipate the claims of the relatives of the San Juan crew and thus reduce the possible impacts on the image of the Cambiemos government.

“It was Mauricio Macri who not only allowed these illegal tasks to be carried out, but also used that information to make decisions. In some cases those decisions had to contain advance information about the claims he would receive or the demonstrations organized by the victims before the visit of the then President to the city of Mar del Plata,” said Judge Bava when he prosecuted him.

“On other occasions, (the questioned decisions were intended) to maintain constant and systematic monitoring of the protest measures of the group of family members who are victims of these illegal tasks,” the judge wrote.

The relatives of the crew members of the San Juan demanded through their legal representatives that the prosecutions issued in the case be confirmed, although they have a low expectation that this will happen, something they pointed out on more than one occasion after the passage of the case. to the federal courts of Buenos Aires.

“As a complaint we know that since the case of illegal espionage was passed on to Comodoro Py, we are facing the chronicle of a death foretold. The signs are unmistakable. The most aberrant warning about the end of this case was the marked difference between the former president and the illegally spied on families. The defendant is treated until Saturday night. He ignores this complaint,” said lawyer Valeria Carreras in dialogue with Télam.

“Perhaps we are facing the final blow on the truth, on justice and on the families that I represent, re-victimizing them, if the defendants are acquitted. However, the families will not stop arbitrating every means and every instance, until They will not be able to do more harm to them than has already been done to them. They will not be able to prevent them from continuing their path of the cross before justice. They have the evidence and they have shown to fight with their hands full of dignity,” he stressed.

More than two months ago, the prosecutor before the Buenos Aires Federal Chamber, José Luis Agüero Iturbe, ruled that the Macri prosecution should be annulled, as claimed by lawyer Pablo Lanusse, who defends the former president.

The prosecutor maintained that in the act of the investigation, Macri “was not imposed the existing evidence against him” so he would not have been given the opportunity to refute it in a timely manner: for this reason he claimed the annulment of the prosecution and the summons to a new investigation in which the facts are alleged to be correct.
