Paraguay asks to complement the extradition request of the former senator

Edgardo Kueiderformer national senator, remains detained in Paraguay for trying to bring in more than 200 thousand undeclared dollars. Now, the Paraguayan guarantee judge, Rolando Duartesent a letter through the Directorate of International Judicial Cooperation and Assistance of the Supreme Court of that country in order to expand and complement the extradition request made by the federal judge Sandra Arroyo Salgado.

This way, the possibility will be delayed that both Kueider and his secretary, Iara Guinsel Costa, be sent detained to Argentina, since the document will be processed to the Argentine embassy in Asunción, heading to the Foreign Ministry.

The opinion of the deputy prosecutor Matilde Moreno was attached by Duarte in his office, in order to “facilitate a greater understanding of what is required and allow the issuance of an appropriate ruling on the extradition request” by Kueider and Guinsel Costa.

According to Moreno, Arroyo Salgado’s request “contains errors that are notable in terms of warrants,” and “generates a confusion that the requesting State is legally obliged to clarify.” The prosecutor had considered that ““did not have the necessary information for an adequate and lawful ruling at this time, due to defects of form and substance attributable to the requesting State.”

Likewise, he stressed that the judge mentioned in form “generic” international conventions that “pursue different purposes and objectives, which could generate inconveniences of framing and even exclusions of one with respect to the other, due to their different scopes of application“.

Furthermore, in conjunction with the extradition request, the request for the seizure of their cell phones was included, as well as the search where they serve house arrest in Asunción, a luxurious property called “Tierra Alta del Maestro”, which has swimming pool, gym, barbecue area and an air-conditioned room for its inhabitants. The judge also issued the international arrest warrant of both in case they were released by the Paraguayan Justice.

Finally, he detailed in his document: “The Argentine Justice does not indicate precisely which are the punishable acts (offenses/crimes) attributed to those requested, an essential requirement for the study – at the appropriate procedural moment – of Double Criminality and guaranteeing the Principle of Specialty”.

“Taking into account that both requested parties are subject to a process in Paraguayan territory, the Public Ministry estimates that such a request could be saved with a specific letter rogatory to achieve the procedural opportunity and right to be heard in a criminal proceedingwhich becomes contradictory in the intention of the procedure,” he concluded.

Kueider’s attempt to overturn the Senate session that expelled him

A few days ago, Justice denied the former senator’s request Edgardo Kueiderdetained in Paraguay when he tried to enter with US$200 thousand without declaring, to declare void the session in which he was expelled from the Upper House, occurred in mid-December.

Kueider is currently serving house arrest in the neighboring country with his secretary, Iara Guinsel Consta. Last week, the now former legislator had claimed, through his lawyers, the authorization of the judicial fair to discuss his expulsion from the Senate.

Now the National Chamber in Federal Administrative Litigation rejected the Entre Ríos request. The decision was made by the judges. Marcelo Duffy, Jorge Morán and Rogelio Vincentiwho pointed out that “the actor himself recognized that the alleged circumstances were hypothetical and that his duties were only due to resume in March.”

Previously, the Federal Administrative Contentious Court No. 6led by Enrique Lavié Pico, had rejected the former senator’s request in limine.

In his argument, Kueider had argued that “the exclusion of the signer from the Senate, On the one hand, what matters is the deprivation of a part of the population that elected me of their constitutional right to political representation, in this case, the Province of Entre Ríos.”

“Respect for political decision of the people of Entre Ríos “It cannot be ignored, nor does it admit delay,” he added. Likewise, he stated that “without due judicial review of what was resolved by the Senate in an illegal process, a dangerous institutional precedent is left, given that the final value judgment that is transmitted for the future is that a Senator can be expelled. , without formal proof – with a photocopy -, without being able to defend oneself, without following due process, without legality, and by obtaining a false majority that vitiated the will of the vote, allowing the legalization of a vote obtained with pressure and Chicanas.”

After the presentation, the prosecutor before the Federal Administrative Litigation Chamber Rodrigo Cuesta asked the court to reject the appeal of former senator Edgardo Kueider and confirm the ruling that validated the session of the Senate of Congress in which he was expelled from the bench.

Claim

Kueider’s lawyers alleged that the vice president of the Nation Victoria Villarruel She could not fulfill her duties as president of the Senate during the session, given that she was exercising the Executive Branch, as the president of the Nation was on a service commission abroad.

From the December 6, the former national senator and his secretary are under house arrest in the Paraguayan capitalAsunción, waiting for the investigation to progress for alleged smuggling and money laundering. There, both accused spent both Christmas and New Year’s Day and will continue to be detained until the Paraguayan Justice determines it or agrees to the extradition requested by the Argentine judge Sandra Arroyo Salgado.
