From the Government, they indicated that the main objective of the new regulations is determine whether or not the granting of the benefit is pertinentafter verifying the total and permanent disability.
Disability: the requirements to determine disability at work change
The resolution begins by establishing: “The Scale for the medical evaluation of disability of Non-Contributory Pensions for Labor Disability be approved in the terms of Article 9 of Law No. 13,478.”
“In accordance with the recommendations made by the National Directorate of Economic Support and Allocations of the National Disability Agency, is appropriate approve a medical scale that contains the guidelines for the analysis of the degree of work disability“, continues the message of the Executive Branch.
“This regulation allows have a classification for each device or systemof the different groups of psychophysical conditions depending on whether they cause work incapacity sufficient for the granting of the benefit, evaluable, low or null”, he points out.
For his part, the Article 9 of Law No. 13,478 maintains that “the Executive Branch will grant to every person not covered by a pension regime, an unattachable old-age pension. This point includes every man or woman, single or widowed, sixty years of age or older; and all “male, married, sixty years of age or older, and any male or female, widowed, sixty years of age or older, and with children under eighteen years of age.”
The new criteria determined by the Government
The conditions for granting the benefit of non-contributory pensions are divided as follows:
- Always favorable: “Sufficient incapacity to generate a favorable medical opinion for the purposes of granting the pension, regardless of socioeconomic factors.”
- Evaluable: “Need for further evaluation (for which you can resort to the scale, the consideration of socioeconomic factors, consult with other doctors or other disciplines or take into account other reliably documented disabling pathologies) since it could generate a favorable or unfavorable opinion due to the degree of disability achieved.”
- Low disability: “Although they produce some degree of disability, it would not reach the degree of disability required to grant the pension even taking into account the other factors.”
- Without disability: “He has some pathology, but absence of disability.”
