This has now brought an action for the continuation of the employment relationship, reports the “Kleine Zeitung” (Friday edition). According to the education department, there were no other dismissals of federal school doctors in connection with the letter.
According to the ministry, the names of eight school doctors at federal schools (AHS, BMHS) were found under the letter questioning the effectiveness and safety of the vaccine in healthy people under 65 without risk factors. The education directorates were then instructed to clarify whether the letter had actually been signed by them and, if so, to issue a dismissal. However, this did not happen in any of the other cases, the people concerned all distanced themselves from the contents of the letter afterwards, the ministry said. In the case of a school doctor in Upper Austria, the contract had expired. The Directorate of Education and Ministry of Education did not want to comment on the Carinthian case, referring to the ongoing proceedings.
The long-standing Carinthian school doctor is outraged at her dismissal in the report in the “Kleine Zeitung”: “I would have agreed to be fired, but I won’t let myself be chased away like a criminal after 20 years,” she is quoted as saying. She is not against the corona vaccination, she only considers the vaccination of children to be problematic. In December, the doctor filmed the phone call with the education department in which she was informed about the termination of the employment relationship and posted it on various social media and channels.
Your lawyer Alexander Todor-Kostic has now filed a lawsuit for the continuation of the employment relationship with the regional court in Klagenfurt, as he confirmed to the APA. The doctor did not set any reason for dismissal, but only exercised her right to freedom of expression. In the event of dismissal, according to the Supreme Court, the reason for dismissal must be so serious that continued employment is also objectively unreasonable, he argues.
