At the end of August last year, the 26-year-old went for a walk with the two-year-old – the child of friends – and her own six-year-old son in the Oberpullendorf district along a stream. The two boys ran on a dirt road in the direction of the bridge, a few meters behind the defendant, who took a call from the boy’s mother. The toddler crouched on the edge of the bridge and fell into the water.
The 26-year-old pleaded not guilty. She would not have known that the creek, unlike usual, was in flood that day. The judge saw it differently and spoke of irresponsibility and gross negligence in her verdict.
The young woman was sentenced to six months of conditional imprisonment and an unconditional fine of 720 euros and 5,000 euros each for mourning pain to the parents.
