Cedears: establish new changes for the collection of fees

Having temporarily suspended the perception of inspection and control rate corresponding to 2024until February 16 inclusive, establishes the form of determination and payment date of the inspection and control fee corresponding to the year 2024 of the obligated subjects.

In that sense, it incorporates the tariff for authorizations of increase of amount of the ARGENTINE DEPOSIT CERTIFICATES (CEDEAR) and SECURITIES CERTIFICATES (CEVA) programs.

Cedears: how the inspection and control rate will be applied

As established in Article 3, the inspection and control fees will become effective in these cases:

to) The Markets, Clearing Houses and Markets with Clearing House function, that are registered as of December 31 of each year, from the 8th to the 12th business day of January of the following year.

b) The Central Depository Agents of Negotiable Securities; Risk Rating Agents, Registration and Payment Agents, Negotiation Agents, RUCA Negotiation Agents, Global Investment Advisory Agents, Settlement and Clearing Agents -Own and Comprehensive-, Settlement and Clearing Agent -Integral / Agroindustrial-; Settlement and Clearing Agents -Direct Participant-; Negotiable Securities Brokerage Agents and Producer Agents -human and legal persons-, who are registered as of December 31 of each year, from the 8th to the 12th business day of January of the following year.

c) Issuers of Shares, Negotiable Obligations, Short-Term Debt SecuritiesARGENTINE DEPOSIT CERTIFICATES (CEDEAR) and/or SECURITIES CERTIFICATES (CEVA), which are registered as of December 31 of each year, from the 8th to the 12th business day of January of the following year.

d) The Administration Agents and Custody Agents of Open and/or Closed Common Investment Funds, as indicated below: In the case of Closed Mutual Investment Funds, depending on the net assets that arise from the annual and/or quarterly financial statements of each of the funds that they manage or custody, the Administration and Custody Agents , in each case, must pay from the 8th to the 12th business day, counted from the due date established for the presentation of the aforementioned financial statements, 25% of the inspection and control fee provided for in the Annex to the Resolution 153-E/2017 of the Ministry of Finance and amendments.

In the case of the Open Investment Funds, Administration and Custody Agentsin each case, from the 8th to the 12th business day of each calendar quarter, and must apply the rate on the daily accrual, in accordance with the net assets reported through the system used for the submission of the information required in these RULES by the Argentine Chamber of Common Investment Funds.

For the purposes of applying the rate, the Current/Actual convention. Likewise, the daily provision made must be accounted for in the fund’s currency, regardless of whether classes of shares denominated in currencies other than that have been issued. Funds for which the Commission has approved the liquidation process will not be included in the base of application of the rate.

In the case of the open or closed funds whose currency is American dollar, It is appropriate to apply the Reference Exchange Rate Communication “A” 3500 from the CENTRAL BANK OF THE ARGENTINE REPUBLIC corresponding to the business day prior to the payment date. In those funds that are denominated in other foreign currencies, the exchange rate published on the website of the CENTRAL BANK OF THE ARGENTINE REPUBLIC will be used, corresponding to the business day prior to the payment date.

and) The Placement and Distribution Agents of Common Investment Funds and the Placement and Distribution Agents Comprehensive Common Investment Funds, which are registered as of December 31 of each year, from the 8th to the 12th business day of January of the following year.

F) Financial Trustees (financial entities and/or corporations), which are registered as of December 31 of each year, from the 8th to the 12th business day of January of the following year.

Entities that are authorized or registered after the indicated dates must pay the annual fee within FIVE (5) business days of obtaining the authorization or registration, respectively.
