Insurance: the Government repealed a rule that generated rejection among insurers

After much asking, finally, the insurers managed to get the new insurance superintendent to grant them a wish: he repealed a rule that completely changed the conditions of Civil Liability for Motor Vehicles.

The National Insurance Superintendency (SSN) repealed a rule that regulated Civil Liability (CR) coverage for Automobiles. This is Resolution SSN 534/2023, which had generated various claims from companies and insurance chambers.

One of the changes he established was that the Basic Mandatory Civil Liability Insurance Policy would become the basic coverage of the Motor and/or Trailed Vehicle Insurance policyenabled shorter terms for contracts and established that when some accessory coverage was granted, the insurer must also provide liability coverage.

On the other hand, that resolution established that entities authorized to operate in Motor Vehicle and/or Trailed Vehicle Insurance could not issue policies more than 30 days in advance of their entry into force.

The norm, which had been approved by the previous management, led by the former superintendent, Adriana Guida, It generated strong rejection from the insurers and the new management in the control body, headed by Guillermo Plate, decided to reverse that resolution.

He did it through Resolution 13/2024which was published this Tuesday, February 6, in the Official Gazette, which repeals the aforementioned regulation of November 16, 2023.

The rule issued this week maintains that the measure was taken on the basis that “The design of clear coverage, easily affordable for insured and insurable people, should be encouraged. that effectively meets the expectations taken into account in its dictation”.

And points out that It is prudent and opportune to evaluate new provisions that result from the consensus of all parties affected and allow enough time to make the changes that are encouraged.
