Change in credit cards: the keys to deregulation

The Government modified part of the regime of Credit cardsseeking to achieve a “strong deregulation and simplification” of that market.

Through Decree 361/2024, published this Friday in the Official Gazette, it regulated two articles of Law No. 25,065 on Credit Cards, linked to the summary of user operations.

Thus, it established that for the purposes of sending the monthly summary of operations provided for in article 22, there should be no opposition from the user when its submission was made electronically.

In addition, it established that the communication channel referred to in article 25 in the event of non-reception of the summary may be telephone, electronic or similar, as long as it fulfills its purpose.

The Executive Branch justified this decision within the framework of DNU 70/2023, which established a series of measures to deregulate the economy.

Among them, Law No. 25,065 on Credit Cards was modified, “in order to carry out a strong deregulation and simplification in that market, adapting to recent changes in relationship modalities and digitalization technologies.”

For the Casa Rosada, DNU 70/2023 states that “the economy must be reconstructed through the immediate elimination of state barriers and restrictions that prevent its normal development, while promoting greater insertion in world trade.”

Among other points, that decree established that Any entity, within its corporate purpose, can issue credit cards or make payment.

It also forced issuing entities to publicly disclose the financing rate applied.
