AFIP with new powers: price control and changes in VAT

According to Decree 658/2024, the agency may update the amounts that determine whether a company is medium-sized, based on annual sales.

By means of Decree 658/2024 “Taxes”, the Government modified the regulations of the Value Added Tax (VAT) Law and the Internal Revenue Law (II). According to the official text, as of January 1, 2025, the obligation to specify non-VAT taxes on invoices or equivalent documents is eliminated.

This means that new rules are being established for “tax transparency for consumers starting on the first day of next year” and procedures and parameters are being adjusted for the application and discrimination of certain taxes on invoices and documents.

Changes in Internal Taxes

Tax rates on certain goods, such as cigarettes, are increased and fixed minimum taxes are eliminated from 70% to 73%.

Procedures are detailed for estimating prices and determining tax bases when adequate market prices are not provided. Some minimum taxes are also eliminated, and new rules are established for determining sales prices to ensure that they reflect market values.

A mechanism is established for quarterly updating of amounts based on the Consumer Price Index (CPI).

Changes in the role of the AFIP

The official text also empowers the Federal Public Revenue Administration (AFIP) which may update billing amounts and sales prices based on indexes and price surveys. It also authorizes the tax collecting agency to collaborate with other public entities and organizations to conduct price surveys.

In other words, AFIP will be able to update the amounts that determine whether a company is a medium-sized company, based on annual sales. These updates will be made regularly and posted on its website. AFIP can also collaborate with other entities to determine the prices of specific products and ensure that taxes are calculated correctly.

Finally, the official text recalls that the Decree seeks to make the tax system more transparent, fair and up-to-date, “by adjusting rates and rules so that they better reflect economic reality and ensure that everyone pays what they should.”
