The definition of the presidency of the highest court for the next three years can be voted on in tomorrow’s agreement or virtually from Córdoba, where the judges will travel this week to pay tribute to Juan Carlos Maqueda, with a clamor operation.
Like a causal image but with multiple messages both inside and out, the majority of the Supreme Court, composed of Horacio Rosatti, Carlos Rosenkrantz and Juan Carlos Maqueda, shared a lunch of “lomitos” yesterday at the La Biela restaurant. Relaxed but in a block seemed to be the signal they sought to give.
This week, the renewal of authorities for the Supreme Court of Justice of the Nation enters the final stages, with the calendar in extra time. They will not wait until next Monday, the last working day of September. Vote could be triggered on Tuesday’s deal –where the Court is going to expel around 300 cases, breaking the record of cases resolved in 2022, reaching 8,500–, at the sole call of the current president Horacio Rosatti. Or, move to virtual mode, where the current four judges of the Supreme Court vote with their token remotelywith a regulation that enables them to speak anywhere in the national territory. Rosatti leaves on Wednesday for Córdoba with final destination to the tribute that will be held for him Juan Carlos Maquedaa constitutional convention member and native of that province, on Thursday.

There are two options and they offer no surprises: a re-election of Horacio Rosatti for another three years, or a castling with the current vice president Carlos Rosenkrantz. No other alternative scenario is being considered and the truth is that it will depend only on the will of the protagonists for what it entails, which includes the presidency of the Council of the Judiciary in the package. There is a feeling in the Court that, sooner or later, Ariel Lijo can land in one of the vocal positions of the highest Court but they are preparing, at the same time, for a scenario in which there will be a lack of judges if Maqueda retires at the end of the yearwhen he turns 75. That does not mean that the mini-tour of Córdoba is not a suitable place to deploy a sort of clamor operation for the continuity of the senior judge whom the Government “retired” early through a statement that was read as a gross lack of respect for the judges.
As proof that they are not afraid of a mini-Court remaining for a while, they claim that the system of drawing substitute judges among the 26 presidents of the Federal Chambers is well-oiled, and they are eager to intervene when the specially designed lottery machine favors them. They have four cameras filming the entire procedure from different angles, as a sign of transparency and to differentiate it from other lottery machines.
The other fact to take into account is also not minor for the Judiciary: With two signatures in a positive sense, the majority of three is achieved for the decisions of the superintendence which, in the end, are what interest the judges. Beyond the fact that now the Court is a collegiate body where each vote counts one, there is no double presidential vote, the decisions of the superintendence end up being structural for the organization of the Judicial Branch. The Government should be interested in the rulings and that is where a Court resorting to associate judges on a permanent basis could cause problems.
“He’s not leaving, Maqueda is not leaving”
Does Maqueda have a chance of staying beyond December? The judge’s own opinion is very interesting and will be known through an interview conducted by journalist Rodis Recalt for the podcast commemorating the feat of the 1994 Constitutional Convention. More or less, Maqueda confesses that he learned, with surprise, that the National Government had announced his departure, publicly, and without giving him time to ask for an agreement to continue for five more years, if the Senate approved it. “It is very, very difficult (for him to continue), but we are in Argentina, a place where someone without structure like Javier Milei became president”he confided to Scope a high judicial source. It remains in the air that It wouldn’t be impossible.
For now, the entire Córdoba itinerary will be a tribute and a farewell to the style “The Chalchaleros” for the Cordoba judge. They will move there Rosatti, Rosenkrantz and Maqueda where each one will have their own agenda, but they will converge at the National University of Córdoba for the tribute ceremony on Thursday.
