The National Electoral Chamber resolved that Ricardo Garramunofrom the Somos Fueguinos party, will be the replacement for Hector Stefanithe deputy who died last month following an illness. Stefani be occupied by candidate Ricardo Garramuño“, the judges explained in the document that revokes their peer’s sentence.
The resolution was approved by a majority. Santiago Corcuera and Daniel Bejas rejected Calvete’s ruling, while Alberto Dalla Vía supported the judge’s decision and justified: “The direct application of the substitution pattern for people of the same gender, provided for in the cited norm without considering the particularities of each district, leads to a solution that is contradictory to the essential purpose of law 27,412 itself.since it implies that a substitute candidate is placed with priority to a regular candidate”.
In the ruling, Calvete had explained: “In this particular case, a manifest unreasonableness in the replacement system adopted by law 27,412 in the case of National Deputies and that is why, before two possible solutions (the replacement of the bench by a man or a woman) one must be sought that guarantees the adequate balance between both in the composition of the legislative body, otherwise it would mean a decrease in the percentage of representation of women in the body, an issue that clearly violates the progressive action that the current legislation in our country in this matter has had in mind”.
In turn, he added: “That said, what is resolved herein, in accordance with the circumstances of the case, would not affect the principles of equality before the lawsince it does nothing more than ensure a tendency towards achieving a real balance of opportunities in access to the Honorable Chamber of Deputies of the Nationuntil these inequalities subside over time.”
Nora was scheduled to be sworn in as a deputy this Wednesday. However, after this resolution his incorporation was suspended, although he will still be able to appeal to the Supreme Court and reverse the decision of the Electoral Chamber. In the event that the country’s highest court of Justice does not change the ruling, Garramuña will be appointed legislator immediately and He will hold the position until December 2025.
