The Constitutional Chamber of the Supreme Court of Justice (TSJ) of Venezuela fined the social network Tik Tok for US$10 million. According to the authorities, the sanction is due to the negative impact that the so-called “viral challenges“popular in the application that generated the death of at least three young people. The sentence was confirmed by the president of the chamber, Tania D’amelio.
“This Constitutional Chamber (…) imposes on the TikTok company a fine equivalent to 10 million US dollars that it must pay to the National Telecommunications Commission within eight days following the publication of this decision on its website. Supreme Court of Justice,” reported D Amelio. The court accuses the social network of “negligence to “not having implemented the necessary and appropriate measures” to prevent the spread of “viral challenges”in violation of the nation’s legal system.

In detail, the sentence was read in the presence of a multidisciplinary team that investigated the cases. Among those attending were the Minister for Education, Héctor Rodríguez; the general director of the National Telecommunications Commission, Jorge Márquez, and the president of the Autonomous Institute National Council for the Rights of Children and Adolescents (Idenna), Anahí Arizmendi.

Venezuela is not the only country where the renowned application faces legal problems. In recent days, the president-elect of the United States, Donald Trump, asked the North American Supreme Court to postpone the application of a law that bans the social network TikTok in the country, at least until he assumes the presidency.
In detail, the United States had passed a law that prohibits the implementation of the ban throughout the territory unless its Chinese owner, the company ByteDancesold the platform. After being approved, the implementation date of this measure was, initially, next January 19, 2025just one day before Trump took office as American president.
Congress had approved this law arguing that it seeks to prevent risks of espionage and manipulation of users by Chinese authorities. For its part, TikTok denies having transmitted information to Beijing and maintains that the law violates its free speech rights protected by the First Amendment.

In this context, the Republican attorney general candidate, John Sauer, detailed that “President Trump urges the court to suspend the law’s effective date to allow his incoming Administration to seek a solution that could avoid a national shutdown. of TikTok.” According to the Republican’s lawyer, waiting to implement the law would preserve “the First Amendment rights of tens of millions of Americans” while also addressing “the Government’s national security concerns.”
