A hope for the Argentines descendants of Italians in justice to achieve double citizenship

We all know that Italy has a debt and it is with those who had to leave their beloved land and today they are in a diaspora in different communities how the Argentine Republic is for example.

The Constitutional Court of Italy is about to resolve a case that can sit jurisprudence and can open the opportunity to obtain Italian citizenship to hundreds of thousands of descendants of Italians residing in Argentina.

The judicial controversy is the questioning for considering unconstitutional the new Law 74/2025 that was issued in May of this year and established that the possibility of accessing Italian citizenship by great -grandparents which is known as Ius Sanguitis, right by blood, was eliminated. The controversial measure directly hit thousands of Argentines descendants of immigrants from Italy. However, the Torino Court declared such legislation as unconstitutional and ordered to send it to the Constitutional Court to be treated.

In Italy, the latest migratory changes focus on the restriction of citizenship by Ius Sanguinis and the expansion of the legal channels of labor immigration. Specifically, access to citizenship is limited by offspring to children and grandchildren of Italians, and a new “Flussi Decree” is approved that increases the quotas of work visas for the coming years.

The doubt and debate in Italian society persists in vast sectors to the point that President Sergio Matellla publicly admitted that this decisions should be reviewed. Sergio Mattarella, upon receiving the directors of the General Council of Italians abroad) at the Palacio del Quirinal, surprised to publicly admit the possibility of corrections to newly approved legislation. The words of Mattarella, live contrast to the position defended so far by the Minister of Foreign Affairs, Antonio Tajani, arrived just after the incisive pronouncement of the general secretary of the CGIE, Maria Chiara Prodi, who, in the name of the agency, denounced the “deep wounds” caused by the new law between the Italian communities abroad. As our Usei Party is also raising that has a wide and deep roots and representation of the Italians from outside of Southern America.

But let’s try to understand what has happened the scope and consequences of these political decisions that justice could reverse today.

Changes in citizenship by ius sanguinis:

Decree Law 36/2025, now Law 74/2025, restricts access to Italian citizenship by offspring (Ius Sanguinis) only to children and grandchildren of Italians born in Italy.

Previously, citizens could be obtained through great -grandparents or previous generations, but this possibility has been eliminated.

A transitory period is established for the organization of a centralized office in farnesina to process the citizenship of those who reside abroad.

Appointments for the presentation of documents and the allocation of new appointments related to the recognition of citizens by Ius Sanguinis are suspended.

We all know that Italy has a debt and it is with those who had to leave their beloved land and today they are in a diaspora in different communities how the Argentine Republic is for example.

Children and grandchildren of those whom Italy did not give them the opportunity to develop and practically put it in the brete to have to leave their land to be able to subsist have the right today of having the double citizenship, now justice has the last word and on each Italian of the diaspora a wave will fall a wave no fresh air recovering a right that should never have been lost. Ius Sanguinis, it is not only a criterion for a citizenship procedure but also implies recognition of a historical right of those Italians then and their grandchildren and great -grandchildren today.
