Workplace violence is contemplated in Law 26,485 on “Comprehensive protection to prevent, punish and eradicate violence against women in the areas in which they develop their interpersonal relationships” as a modality and is defined in ILO Convention 190, the first international document which recognizes the right of everyone to a work environment free of violence. In other words, what regulatory and legal coverage exists.
Argentina was the fourth country in the world to ratify the aforementioned Convention and although we still do not have a national law that sanctions this type of violence, the State, the unions and the private sector are taking very interesting initiatives to address it – not without difficulties – on especially when there are no open areas of discussion with effective union participation through collective bargaining.

The Argentine Development Bank BICE adhered to the Zero Tolerance Campaign for Violence against Women promoted by the Gender Cabinet of the Industry and Productive Development Secretariat of the Nation. It is about the signing of an act of commitment to achieve environments free of violence. In fact, these days BICE Trusts also joined.
For its part, the Ministry of Women, Gender and Diversity is promoting the Igualar program, to which BICE recently joined, and whose objective is “reduce the gaps and structural gender segregation that exist in the world of work, employment and production from an intersectional and human rights perspective”.
Meanwhile, the Undersecretariat for Policies for Inclusion in the Labor World of the Ministry of Labor is promoting the Qualitas 190 program, a plan “for development, training and advocacy in the area of prevention and eradication of violence and harassment at work from a multidisciplinary view”, aimed at employer organizations and on repeated occasions it has worked in conjunction with trade union organizations.
Once again, the work in alliance between the public and private sectors and the union organizations is necessary to take firmer steps and protect the workers. Much remains to be done to ensure that work environments are free of violence, but the joint effort that is being carried out bodes well, which will be reinforced when we have a national law.
