On December 14, the first deputy chairman of the international affairs committee of the lower house of parliament, Alexei Chepa, expressed disagreement with the decision of the European Court of Human Rights (ECHR) on the obligation of the Russian Federation to pay € 370 thousand to Margarita Gracheva, whom her ex-husband cut off her hands.
“Well, first, why should the Russian Federation heal, and not the person who committed the crime? I do not understand. I do not support the court’s decision and I think that it is wrong to shift the blame from this person to the state, ”he stressed in an interview with Duma TV.
The parliamentarian also commented on the position of the ECHR that Russia allegedly did not take measures to prevent the crime, and the police were passive. In his opinion, family relationships are complex and it is difficult to assess who is to blame for such conflicts.
“In my opinion, if he beat her all the time, it’s one thing, if it wasn’t there, if there were no prerequisites for this or there were no prerequisites. Well, it is unlikely that he was dragging her by the hair, and the police turned away and did not take any steps, ”Chepa said.
He added that he was very sorry for the injured woman, and also called the incident a big disaster.
In turn, the chairman of the Rostov regional collegium of lawyers “Parity” Nadezhda Shvyreva explained the principle followed by the ECHR in calculating the amount of compensation to victims. According to her, the European Court considers each situation individually.
“This takes into account the age of the person, the level of his income for the specified period, etc. That is, the meaning of the calculations carried out by the ECHR boils down to ensuring that this moral compensation compensates not only for moral damage, but ensures a comfortable existence in conditions of limited opportunities, ”the specialist clarified.
She also noted that the percentage of non-execution of ECtHR decisions on the territory of the Russian Federation is small.
The decision of the European Court states that Russia must pay Gracheva € 330,660 for medical services and expenses due to loss of income, as well as € 40 thousand in compensation for non-pecuniary damage.
The ECHR accepted the relevant complaint by Gracheva for consideration in July 2019. Then the court also received about 10 complaints against Russia concerning domestic violence in the family.
The woman’s ex-husband, in a fit of jealousy, cut off her hands in December 2017. The court sentenced him to 14 years in a maximum security colony. The victim called the verdict not harsh enough, adding that she did not see the remorse during the process. The doctors managed to save one of the woman’s arm, and a prosthesis was installed in the place of the second.
