Lawyer Dmitry Kvasha told about the responsibility of the owner of a private kindergarten, where on Tuesday, December 14, a child fell out of the window.
“A kindergarten should not be confused with a leisure center where children are looked after. The main difference is that there is no training in the children’s center. Therefore, one cannot say that such centers are located illegally on floors higher than the first. They have this right. A private kindergarten is an analogue of a regular kindergarten. It is subject to licensing, that is, information about it must be submitted to the administration, since it conducts some kind of education for children. The childcare group is not subject to any licensing, ”the expert explained.
As the lawyer noted, in order to organize such a kindergarten, you just need to register a legal entity – an individual entrepreneur or a limited liability company – and rent a room. According to him, there are entrepreneurs who organize kindergartens, hiding behind the fact that they have a leisure center. Kvasha clarified that such an institution can be located anywhere, no strict restrictions are provided.
“We need to think about how to protect children from falling from a height, from various sharp and stabbing objects. This is, in principle, provided in all kindergartens, where all toys are wooden and cannot injure children. This is not the case here. Windows on high floors should be barred to avoid tragedy. Such “private kindergartens” are legally given all freedom. Such kindergartens are located in apartments over 100 sq. m. The number of placed children depends on the entrepreneur’s greed, ”he said.
Kvasha stressed that in the event of an emergency, responsibility lies both with the employee who was responsible for the safety of children at the time of the incident, and with the owner of the kindergarten.
“Until we have a sufficient number of kindergartens, parents will look for alternative options. Tightening the legislation alone is not enough here; a competent social policy is needed here. The business owner can be attracted under the article on illegal entrepreneurship. As for the criminal liability, everything depends on the authorities that will investigate this case, ”the lawyer summed up.
