How good an idea is it to be on the run?

Abel Guzman, the colorist who allegedly shot a colleague to the head, escaped from the hair salon after being implicated in the crime. All measures aimed at finding his whereabouts seem to have no results.

They searched for him in various places: His home in Merlo, his mother’s house in Santiago del Estero and other locations of his acquaintances without being able to find his whereabouts.

On the other hand, it would seem that the famous phrase that reads ““Everyone falls for the phones”; making it clear that the main enemy of anyone who committed a crime or is a fugitive is their cell phone. In fact, the researchers were struck by the fact that everyone in the hairdresser’s immediate environment had turned off their cell phones just like him from the moment the incident occurred.

Now, this path has short legs no matter how effective the accused is in avoiding the actions of justice. The reality is that living outside the law is not only exhausting but also complex to sustain and even more so in a media case.

Another complication that occurs when fleeing is that, if the accused is found, there is an enormous chance that he will be arrested and placed in preventive detention as soon as possible. Under these conditions, it also becomes very complex to obtain a prompt release or a mitigation of the coercive measure mentioned.

This is because the fugitive is demonstrating from that position the existence of procedural risks. How can someone who has been doing so up until now not try to evade the actions of justice?

It is true that the hairdresser’s situation is extremely complicated, not only because of the media coverage of the case, but also because the crime for which he is accused is serious, and because there seems to be evidence against him. And unless the security camera video that he revealed is a creation of artificial intelligence, it would seem that said evidence would be compelling.

In any case, there are no impossible cases, there is always a way to carry out an effective and functional technical defense for the interests of the accused.

Although putting yourself at the disposal of justice seems to be an extremely difficult decision to make, it could be a great step on that path. This would allow him to face the process appropriately, enjoying all the tools that the defense has as a party in the criminal process.

On the other hand, it often happens that the accused declared rebellious is prevented from appointing a defender, greatly affecting his right to defense. The criterion would be that it cannot be admitted that whoever violates the rules of the process has procedural dialogue with the judge of the case, which makes the presentations of him and his defender inadmissible. Therefore, taking the law helps to avoid less burdensome penalties.

Guzmán’s mother, possibly unaware of all this, seemed to understand when she recently said: “Let’s pray that my son turns himself in soon!

Being a fugitive is assuming that the criminal process will be complicated. Taking action, on the contrary, is a sign of good will, of predisposition, a gesture that demonstrates the absence of procedural risks, and therefore, a crucial card to try to be released or enjoy a less burdensome means of coercion.
