The Tenth Arbitration Court of Appeal confirmed the rejection of the claim by Pavel Grudinin, director of CJSC State Farm named after Lenin, who asked to declare the report on the assessment of the state farm shares owned by him unreliable. This was announced on Friday, December 24, by the press service of the court to the Russian Agency for Legal and Judicial Information (RAPSI).
On November 11, the Arbitration Court of the Moscow Region dismissed Grudinin’s claim to challenge the valuation of his shares in the Lenin State Farm.
The basis for the claim for the valuation of the shares was the court ruling that came into force to recover from Grudinin 1 billion 66 million rubles in favor of the Lenin State Farm for the damage caused to the enterprise in 2018. Then Grudinin refused to comply with the court’s decision, in this regard, enforcement proceedings were initiated against the entrepreneur, within the framework of which bailiffs evaluated the shares of Sovkhoz. The securities will be used to pay off the debt.
The appraisers set the starting price for a block of 974,391 shares of Pavel Grudinin in the amount of 630 million rubles. The entrepreneur insists on the amount of 4.8 billion rubles. This was the reason for challenging the expert assessment in court.
On October 30, 2018, the shareholders of the enterprise demanded to recover from Grudinin real damage in the amount of about 1.1 billion rubles. On January 31, 2019, the shareholders filed a new lawsuit in the amount of 1 billion rubles for lost profits. In their opinion, the damage was caused by the transaction on the contribution by the state farm to the authorized capital of LLC TT Development in 2008 of two land plots with a market value of about 1.1 billion rubles.
The plaintiffs in the case were Ivan, Tamara and Olga Markin, Alexander and Dmitry Eroshkin and Nina Solodovnikova. Later, Grudinin’s ex-wife Irina joined them as a co-plaintiff. Three children, two of whom are still minors, are involved as third parties. Also, the third party is another shareholder of the state farm, Alexander Fedorov.
