On the portal of the Federal Notary Chamber (FNP), a Register of orders to revoke powers of attorney issued in simple written form has been launched. On Tuesday, January 4, the organization said in a statement.
The service allows you to quickly revoke a power of attorney that has not been certified by a notary. This can be done through your personal account using an enhanced electronic signature.
Fast revocation of a power of attorney is important, first of all, from the point of view of security and protection from abuse by attorneys in a situation where the principal has already decided to revoke his powers.
A power of attorney canceled through the portal will be invalidated the next day after the order is sent. In this case, it will be considered that all interested parties are notified of the fact of cancellation. For comparison, the previous procedure for informing about the cancellation of powers of attorney through the print media could take a month in terms of time.
On the page of the service for checking powers of attorney of the FNP portal, it also became possible to check any power of attorney that someone presents for cancellation. By entering the details of the document, users will be able to make sure that the power of attorney they are interested in, issued in a simple written form, is valid or, conversely, find out in time that it has already been canceled by the principal. Thus, the new register of notaries will minimize the risks of taking legally significant actions on canceled powers of attorney.
On November 15, the Federal Notary Chamber announced that fraudsters continue to use fake powers of attorney extensively. Scams of this kind are often “cranked” in transactions that are carried out in so-called simple writing, the organization noted.
