In Moscow, a woman was fined for spending money from a wallet found on the street. This was announced on January 18 by the press service of the Second Cassation Court of General Jurisdiction.
The woman found a purse with money and documents at the entrance. She spent the money and kept the wallet at home until the police arrived.
The Muscovite was found guilty of theft, fined 25,000 rubles, and ordered to return the 40,000 rubles spent to the victim.
The woman challenged the verdict in the appellate court, and then in the cassation court. She asked to be acquitted, arguing that the purse found should be regarded as a find and that “she had no intention to steal property.”
However, the arguments of the Muscovite were found by the judicial board to be unconvincing, since she “did not take any actions aimed at returning the found thing to its rightful owner, did not report this to the police or to another official body.”
In November 2020, lawyer Yulia Kuznetsova told how to deal with the money found.
According to the lawyer, if someone else’s things are found, it is necessary to immediately inform the owner about this. You can establish his identity, for example, in cases where the money was in the wallet and there is some data there.
If it is impossible to establish the owner, then the person is obliged to report the find to the police or local government.
