Notaries spoke about the possibility of conducting housing transactions without intermediaries

Currently, there are many opportunities for citizens to independently participate in housing transactions – without the involvement of attorneys or intermediaries, while maintaining all the necessary legal guarantees. This was announced on Friday, January 21, by the Federal Notary Chamber.

For example, for settlements on transactions, a notary’s deposit is used. Over the past year, this notarial action was addressed almost 8300 times. This tool eliminates the need to cash out, transport and transfer money from hand to hand or through a bank cell. The buyer transfers the required amount to the notary’s account in a non-cash form, and the notary transfers it to the seller only after registration of the transfer of ownership.

Deposit accounts of notaries can be opened only in large banks – with a capital of 20 billion rubles. And even if the bank goes bankrupt, the money will quickly return to the owner, because they do not fall into the bankruptcy estate. In 2021, the number of notarial actions for accepting monetary amounts as a deposit increased by 36% compared to 2019.

Since 2021, the notarization of the contract has become available to people who at the time of the transaction were located in different parts of the country through new remote technologies.

The remote format may be relevant when selling shared real estate, when three or four owners are involved, living in different localities. Meeting everyone in one place in this case is extremely problematic. A remote transaction implies that each party goes to the nearest notary’s office and does not specifically go anywhere. At the same time, an unlimited number of participants can be involved in remote transactions. The only condition is that one of the notaries must work in the region where the apartment, house or land offered for sale is located.

On January 13, Alexander Sagin, a member of the board of the Moscow City Notary Chamber, told Izvestia about two popular real estate fraud schemes.
