Justice ordered the Government to resolve requests for the delivery of medicines to vulnerable people

The Justice ordered the national state solve requests for delayed medications and subsidies and adapt all its procedures to the 60-day period for resolution established by the Administrative Procedures Law.

This is a precautionary measure that was issued by the Federal Civil and Commercial Court No. 2, in charge of Marcelo Bruno Dos Santos, within the framework of the collective process promoted by a set of civil associations that represent patients with cancer and other serious diseases.

Their objective is to protect the rights to health and life of people who require medication or assistance in their medical treatment and are awaiting the resolution of their files before the Directorate of Direct Assistance for Special Cases (DADSE) dependent on the Ministry. of Health of the Nation.

Specifically, the amparo was presented in April. lThe composition of the group includes all the people who required medical assistance from the DADSE and who have a file whose processing has been suspended by the decisions of this administration (suspending the procedure to obtain a budget, lack of appointment of a Director o Deputy Director, lack of institutional dependence on any Secretariat, lack of sufficient budget).

The purpose of the claim is to establish the obligation to designate DADSE authorities, to sanction a procedure that respects both due process and the required urgency, to allocate a sufficient number of personnel and public employees who can respond to the requirements within a period of no more than 20 days, and to guarantee the existence of the necessary budget throughout the year.

The defendant is the National State – Ministry of Health – Directorate of Direct Assistance for Special Situations.

At the same time, the Federal Justice of Mendoza suspended through a precautionary measure the obligation for PAMI members to make a new registration to access free medications. The measure, which was promoted by a retiree association, is only applicable to the province of Cuyo.

The presentation was made by the group Association for the Defense and Promotion of the Rights of the Elderly (Jubypen), with the sponsorship of lawyers Carlos Blanco and Marisa Uceda, presented a precautionary measure requesting that the obligation to make a new registration be suspended to access medications.
