The Government will renew contracts for 40,000 public employees until the end of March

The Government of Javier Milei decided to renew the contracts of some 40,000 employees of the national public administration for a period of three monthsuntil the end of March 2025. The measure will only affect those workers who are not part of the permanent state plant.

The Government will extend national public administration contracts

In line with this, and with the beginning of the new year, The Government decided to renew the contracts of 40,000 public employees until the end of March.

In detail, these contracts are covered under the Article 9 of the Employment Regulation Framework Law National Public that establishes regimes for a certain time for transitory or seasonal services. It is expected that this will be the last extension since, in the meantime, all employees will have to take the General Assessment of Knowledge and Skills.

So far 14,000 employees have taken the exam, and 95% passed.

The suitability exam – promoted by the Minister of Deregulation and State Transformation, Federico Sturzenegger -, presents a questionnaire divided into three categories: reading comprehension, logical-mathematical reasoning and public administration.

As detailed from Casa Rosada, the decision on who will continue in their position and who will not will be determined by two conditions: Employees must pass the suitability exam and their bosses must consider that they fulfill a necessary function for the area.

Despite the numbers communicated by the Government, ATE reports that there are 55,000 employees whose contracts expired on December 31, 2024. This calculation also includes the monotributistas under service leasing and the 2,400 employees who depended on the Association of Automotive Dealers of the Argentine Republic (ACARA), a cooperating entity of the Ministry of Justice to expedite the procedures in automobile registrations. The Government has already announced that it will disengage workers who have an agreement through ACARA.

  • Term appointments in the Transitional Plants provided for “by article 30 of the General Collective Labor Agreement for the National Public Administration, approved by Decree No. 214 of February 27, 2006 and its amendments.”
  • The contracts provided for in article 9 of the Annex to Law No. 25,164 and its regulations.
  • Hiring for an indefinite period, fixed-term, part-time and temporary work provided for in articles 90, 92 ter, 93 and 99, respectively, of the Employment Contract Law No. 20,744.
  • Contracts for the provision of self-employed professional services provided for by Decree No. 1109 of December 28, 2017.
  • Temporary appointments in simple positions of the permanent staff.
  • The hiring of personnel with or without a dependency relationship, under any modality, provided for in special statutes or non-budgetary financing sources.

Those designations that include: he National System of Science, Technology and Innovation; the Universities; he National Foreign Service; he National Park Ranger Corps; the SFire Management System and in the personnel included in the Collective Sectoral Labor Agreement of the Professional Staff of Hospital and Care Establishments and Research and Production Institutes dependent on the MINISTRY OF HEALTH.

On the other hand, The changes decreed will not apply either by the Government for those “organizational units incorporated into the Nomenclator of Executive Functions of the Collective Sectoral Labor Agreement of the Personnel of the NATIONAL PUBLIC EMPLOYMENT SYSTEM (SINEP)”, the extensions of transitional appointments and contracts, the appointments of Cabinet Personnel, the hiring of the Mobility and Internal Search Program (MoBI), coverage of positions or hiring that fulfill the Disability Quota and the appointments and hirings that are made as a result of changes in the service provision regime.
