The Prosecutor General’s Office proposed to seize the property of organizations on account of wage arrears

The Prosecutor General’s Office initiated the development of a bill that would allow the seizure of property from enterprises to pay wage arrears to employees. This was reported to Izvestia in the press service of the department.

Recall that, under the current law, it is possible to collect debt on employees’ salaries only from the organization’s cash accounts. And at the expense of property, debts are extinguished only if the enterprise is declared bankrupt.

The Prosecutor General’s Office noted that their initiative is designed to improve the mechanism for extrajudicial collection of wage arrears. They recalled that back in 2019, the State Labor Inspectorates (GIT) received the authority to enforce the collection of wages from employers without going to court. But in practice, until the second half of 2021, most debts were still collected according to court orders, which were issued on the basis of prosecutorial statements.

“The work of the State Labor Inspectorates in this direction was not sufficiently effective. This, among other things, is hindered by the inability to recover wage arrears at the expense of any property of the debtor, ”the Prosecutor General’s Office noted.

Amendments to the law “On Enforcement Proceedings”, which will allow paying off wage arrears, including through the seizure of the debtor’s property, are currently being discussed in the Ministry of Labor, the Prosecutor General’s Office said.

For 2021, the GIT forcibly collected from employers the salaries of employees in the total amount of 364.4 million rubles, the Prosecutor General’s Office added. This is almost 11 times more than in 2020.
