Imagine the following picture: a club in which dancing and celebrating. There are 16 bouncers in front of the door and around the dance floor. They make sure that everyone adheres to the house rules and that no forbidden moves are shown. The club stands for our democracy, the house rules for the Basic Law and the dance moves for the actions of the state and its actors. The bouncers are the judges of the Federal Constitutional Court. Do left or AfD help the new constitutional judges?

In the late Monday evening, the Bundestag election committee agreed to send two candidates from the SPD and one of the Union into the race: Frauke Brosius-Gersdorf, Ann-Katrin Kaufhold and Günter Spinner. At first it did not look as if the government parties dance in the same rhythm.

Frauke Brosius-Gersdorf, nominated by the SPD, caused frowning at the Union. This had been strongly compatible with the obligation to vaccinate during corona apandemia. Her attitude to abortion has also brought some conservative MPs on the scene. The CDU member of the Bundestag Saskia Ludwig, for example, even described the Jura professor on platform X. Aua.

So is Brosius-Gersdorf doomed to fail? According to the DJ aka Union faction leader Jens Spahn (CDU), one was able to agree on a compromise. Accordingly, the Social Democrats should assure that Brosius-Gersdorf should not become Vice President of the Constitutional Court.

The final decision in the Bundestagplenum is to be made on Friday. But here comes the catch: Union and SPD have no two -thirds majority together with the Greens. And this is necessary for the election of the constitutional judges in SPE. So it takes either the voices of the left or the AfD. It doesn’t work without one of the two. However, in a fundamental decision, the Union has determined not to swing the legs with any of the two opposition parties.

The AfD parliamentary group management recommends that its members vote for the Union candidate. But for the SPD candidates? No thanks! And the left wants to talk to the Union before choosing their candidates.

Well, and now? There is still some time to find the right dance steps by Friday. Perhaps the necessary majorities can be obtained through skillful conversations. After all, the choice is secret and, who knows, maybe someone will put a few surprise moves. If the candidates fail in the Bundestag, the GroKo parties would take their toes properly at the Wahlwalk.
