Germany is looking for three new judges for the Federal Constitutional Court. The parties agree on two candidates. But the third threatens to split the coalition.

The Bundestag has postponed the elections of three judges for the Federal Constitutional Court. The plenary took a corresponding decision with the votes of left, Greens, SPD and Union. The AfD voted against it.
The majorities were considered uncertain even before the scheduled election dates. It brewed in the Union.
Three elections were originally planned. The Union sent the previous judge at the Federal Labor Court, Günter Spinner. The SPD had nominated the Jura professor Frauke Brosius-Gersdorf and Ann-Katrin Kaufhold.
Resistance to SPD candidate Brosius-Gersdorf
There are reservations about Brosius-Gersdorf in the CDU/CSU. Among other things, it is about their positive attitude to an obligation to vaccinate during Corona pandemic, on the other hand, about their from the perspective of some MPs to liberal attitude towards abortions. Finally, there was also a suspicion of plagiarism against them. This questioned Brosius-Gersdorf’s professional expertise, it said from the Union faction. But that was the central argument for the choice of the candidate.
These prominent names newly move into the Bundestag
Hendrik Streeck (CDU)
Most of them still know him from the Pandemie period. Streeck is a virologist at the University Hospital Bonn and regularly appeared in public during the Corona crisis. In the course of pandemic, he spoke out for a relaxation of the measures. Now the doctor goes into politics: at 33 percent he brought the direct mandate in Bonn for the CDU

In addition, the CDU/CSU could have been dependent on the AfD votes for the choice of its candidate. The Union faction has so far rejected conversations with the left. The AfD parliamentary group leadership recommended its MPs to the election of Spinner and advises against the election of the two SPD candidates. Without the voices of the left, those of the AfD could have been decisive. However, the elections themselves would have been secret.
Federal Constitutional Court needs new judges
The left had asked for talks with the Union and in the long run the opportunity to make suggestions for constitutional judges themselves. According to the previous agreement in the Bundestag, the Union, SPD and Green judge candidates can propose.
Representatives of the Union faction management had recruited in the past few days to choose Brosius-Gersdorf despite resistance in their own ranks.
