Last week the election of new constitutional judges in the Bundestag failed. Too many in the Union think the SPD candidate is not clear. This now clarifies a lot. But does that help?
Is she a radical left and therefore unclear as a judge at the Federal Constitutional Court? The SPD candidate Frauke Brosius-Gersdorf has been spending the first time since the burst election in the Bundestag himself-and clearly rejects public allegations. “The name of my person as” ultralinks “or” left -wing radical “is defamatory and unrealistic,” writes the lawyer in a statement that she published through a law firm.
The German press agency has the letter. At first ZDF and Deutschlandfunk had reported about it. In it, Brosius-Gersdorf also accuses the media that their reporting was “incorrect and incomplete, unimaginable and non-transparent”. “It was not subject -oriented, but directed by the goal of preventing the choice.” Criticism should also “put up with individual state officials”.
Why Union politicians reject the candidate
Actually, Brosius-Gersdorf was to be elected in the Bundestag last Friday together with another judge and a judge for Karlsruhe. However, the election was taken from the agenda at short notice because the management of the Union faction could no longer guarantee the support for the Jura professor agreed with the SPD.
Several Union MPs publicly described Brosius-Gersdorf as unsuitable and uneliable, others could be quoted anonymously that the law professor was “an ultra-link lawyer”. This was justified, among other things, with statements from Brosius-Gersdorf to Corona vaccinations and with their attitude to abortions.
Group leader Jens Spahn admitted to the parliamentary group this week: “We underestimated the dimension of the basic and content -based concerns about one of the candidates.” And: “The emergency brake on Friday was late.” It was no longer able to find a compromise with the SPD.
What Brosius-Gersdorf himself says about it
In her written statement, the lawyer comments in detail about the allegations. “A picture of the democratic center shows itself politically,” she emphasizes, for example. One -sided attributions such as “Ultralinks” and “left -wing radical” lack the facts. “They are based on a selective and incomplete selection of individual topics and theses, to which individual sentences are torn out of context in order to draw a distortion.”
So the claim is wrong that it is for legalization and impunity of the abortion until birth. She only pointed out the fact that, according to the current legal situation, it was also inadmissible for medical reasons – for example in the event of danger to women’s life and health. “The accusation that I would stand up for a demolition of pregnancy until birth and is” life-critical “is wrong and lacks every basis,” emphasizes Brosius-Gersdorf.
The lawyer said that their positions for a ban on headscarves and parity models for the election of the Bundestag were also reproduced incorrectly.
The situation seems to be stuck. The fact that Brosius -Gersdorf withdraws her candidacy – as some in the Union want – seems unlikely. The SPD also sticks to it and sees itself encouraged. “Professor Brosius-Gersdorf confirms with her explanation exactly what we have been saying for days: The statements accused of it were wrong, shortened or inaccessible,” said faction vice Sonja Eichwede of the German Press Agency. The Union called again to seek a conversation with Brosius-Gersdorf.
CDU and CSU have not yet commented on this. The Union emphasizes that there is no time pressure for a solution – but also does not give the impression of changing its content. A common, majority-capable candidate package can only be achieved with less mutual allegations and more respect for the Federal Constitutional Court, the candidates and the decision of the MPs, said CSU state group boss Alexander Hoffmann of the German Press Agency. In the late afternoon, the board of the Union faction wants to advise further procedures.
When a new judge election could be scheduled
So far, everything indicates that you first go into the parliamentary summer break and that a new judge’s election in the Bundestag is targeting in September at the earliest. This is far too late for the Greens: they are calling for a special meeting of the Bundestag this week. “We consider it irresponsible to leave this important decision of the Bundestag over weeks,” the parliamentary group leader Katharina Dröge and Britta Haßelmann warn in a letter to their counterpart Jens Spahn from the Union and Matthias Miersch from the SPD.
Left boss Ines Schwerdtner, on the other hand, is currently rejecting a special meeting. She was very pessimistic that there could be an agreement in a “rushed session”, Schwerdtner told the newspapers of the Funke media group. Instead, the Union has to use the summer vacation to find majorities. “The responsibility for this is clearly due to the CDU,” she emphasized.
